Notice and Opportunity to Comment on Requests for Consistency Agreement/Concurrence Under the Texas Coastal Management Program
On January 10, 1997, the State of Texas received federal approval of the Coastal Management Program (CMP) (62 Federal Register pp. 1439 - 1440). Under federal law, federal agency activities and actions affecting the Texas coastal zone must be consistent with the CMP goals and policies identified in 31 TAC Chapter 26. Requests for federal consistency review were deemed administratively complete for the following project(s) during the period of June 15, 2026 to June 26, 2026. As required by federal law, the public is given an opportunity to comment on the consistency of proposed activities in the coastal zone undertaken or authorized by federal agencies. Pursuant to 31 TAC §§30.20(f), 30.30(h), and 30.40(e), the public comment period extends 30 days from the date published on the Texas General Land Office web site. The notice was published on the web site on Friday, July 3, 2026. The public comment period for this project will close at 5:00 p.m. on Sunday, August 2, 2026.
Federal License and Permit Activities:
Applicant: Cheniere Energy
The project site is located in Corpus Christi Bay, at the La Quinta Ship Channel and the La Quinta Turning Basin, southeast of Gregory, in San Patrico County, Texas.

Project Description: The applicant proposes constructing the CCL Stage 4 Project, a new marine facility, associated with an expansion of their existing liquefied natural gas terminal. The proposed CCL Stage 4 Project consists of liquefaction trains, LNG storage tanks, flares, and supporting infrastructure, all of which would occur in uplands. Jurisdiction work associated with the proposed expansion includes one new marine berth, a jetty (LNG loading dock), and a marine offloading facility (“MOF”). Specifically, work within the Corps’ jurisdiction includes the following:

New dredging of 8.09 acres of open water, by manual or hydraulic dredging

New dredging of 0.84 acre of tidal wetlands, by manual or hydraulic dredging

Placing fill material into 0.55 acre of tidal wetlands for fill slope protection
The proposed project includes construction of the following structures in Corpus Christi Bay adjacent to the La Quinta Ship Channel:

A new marine jetty with mooring and breasting dolphins, walkways and catwalks, including the above noted dredging to a depth of -45 feet below MLLW +2 foot over dredge, +2 foot advance maintenance

A roll-on-roll-off dock and a life-on life-off dock for use as MOFs, including the above noted dredging to a depth of -30 feet below MLLW +2 foot over dredge, +2 foot advance maintenance

Sheet pile bulkheading along the shoreline

Placement of rip rap for shoreline protection along the shoreline and in dredged areas adjacent to the shoreline
Structures would be constructed a minimum of 562 feet from the top cut of the federal channel to a maximum of 956 feet from the top cut of the federal channel.

The proposed project would require a total of 1.2 million cubic yards to be dredged in one cycle as new work dredging. Depending on capacity and availability, hydraulically dredged material is proposed to be placed into Dredged Material Placement Areas (DMPAs) 13, 14, Good Hope, and Ingleside. If found to be suitable, mechanically dredged material is proposed to be used for fill on the project site.

Impacts associated with the proposed work would include dredging impacts to 0.55 acre of tidal high marsh, 0.29 acre of tidal low marsh, and 8.09 acres of seagrass beds. In addition, the 0.55 acre of tidal high marsh is proposed to be filled to construct and stabilize the sheet pile bulkhead (see impacts table on Page 13 of the project plan set https://www.swg.usace.army.mil/Portals/26/SWG-2022-00304_20260616_Project%20Plans_Red.pdf).

The applicant has stated that they have avoided and minimized environmental impacts to waters of the United States associated with the proposed activity through design considerations. Impacts to 0.49 acres of tidal wetland (0.11 acres high marsh and 0.39 acres low marsh) and 1.02 acres of seagrass were avoided through design considerations. The applicant has proposed to mitigate for the unavoidable loss of tidal wetlands and seagrass through compensatory mitigation and has prepared conceptual mitigation plan. At this time the proposed conceptual compensatory mitigation has not been verified or evaluated. The USACE will determine the type and amount of compensatory mitigation necessary to offset losses of waters of the United States which may result from the proposed activity in accordance with 33 CFR § 332.
Type of Application: U.S. Army Corps of Engineers permit application # SWG-2007-01637. This application will be reviewed pursuant Section 404 of the Clean Water Act and Sections 10 and 14 of the Rivers and Harbors Act of 1899. Note: The consistency review for this project may be conducted by The Railroad Commission of Texas as part of its certification under §401 of the Clean Water Act. The U.S. Army Corps of Engineers Galveston District has found that this permit request meets the terms of Executive Order 14156 and is therefore subject to special emergency permitting procedures and an expedited review process.
